1. Agreement to Terms

By downloading, installing, accessing, or using the Study Mood application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (“User”, “you”, or “your”) and Nestor Studio (“Company”, “we”, “us”, or “our”) governing your use of the Study Mood application.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18 years of age (or the age of legal majority in your jurisdiction), you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the App, you represent and warrant that:

  • You meet the age requirements stated above
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations

3. License Grant

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install the App on devices you own or control
  • Access and use the App for your personal, non-commercial purposes

3.2 License Restrictions

You agree NOT to:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Remove, alter, or obscure any proprietary notices on the App
  • Use the App for any commercial purposes without our written consent
  • Use the App in any manner that violates applicable laws or regulations
  • Circumvent or disable any security features or restrictions in the App
  • Use automated systems (bots, scrapers) to access the App
  • Interfere with or disrupt the App or servers connected to the App
  • Upload or transmit viruses, malware, or other malicious code
  • Use the App to harass, abuse, or harm others

4. Subscription Terms

4.1 Study Mood Pro Subscription

The App offers an optional paid subscription service called “Study Mood Pro” which provides access to premium features including:

  • Unlimited AI-powered study plan generation
  • Advanced customization options
  • Additional features as described in the App

4.2 Subscription Plans

Available subscription plans may include:

  • Monthly Subscription: Billed monthly at the rate displayed in the App
  • Annual Subscription: Billed yearly at the rate displayed in the App
  • Lifetime Purchase: One-time payment for permanent access

Prices are subject to change. Current pricing will be displayed in the App before purchase.

4.3 Payment and Billing

  • Subscriptions are billed through your Apple ID account
  • Payment is charged at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings
  • Any unused portion of a free trial period will be forfeited upon subscription purchase

4.4 Free Trial

We may offer free trial periods for new subscribers. You will be charged the subscription fee when the trial period ends unless you cancel before the trial ends. We reserve the right to modify or cancel free trial offers at any time.

4.5 Refunds

Refund requests are handled by Apple according to their refund policy. We do not have direct access to process refunds for App Store purchases. To request a refund:

  1. Visit reportaproblem.apple.com
  2. Sign in with your Apple ID
  3. Select “Request a refund”
  4. Follow Apple's instructions

Generally, refunds are issued at Apple's discretion and may be granted for:

  • Technical issues preventing use of the App
  • Accidental purchases
  • Other circumstances as determined by Apple

5. User Accounts and Registration

5.1 Account Creation

While the App may not require account creation for basic functionality, certain features may require you to:

  • Provide accurate information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

5.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

6. User-Generated Content

6.1 Your Content

The App allows you to create, store, and manage content including:

  • Study plans
  • Notes and annotations
  • Resource links
  • Other materials (“User Content”)

6.2 Ownership

You retain all ownership rights to your User Content. By using the App, you grant us a limited license to:

  • Store and display your User Content within the App
  • Process your User Content to provide App functionality
  • Back up your User Content through iCloud (if enabled)

6.3 Content Responsibility

You are solely responsible for your User Content and warrant that:

  • You own or have the necessary rights to use and authorize use of your User Content
  • Your User Content does not violate any third-party rights
  • Your User Content does not contain illegal or harmful material

6.4 Prohibited Content

You agree not to create, upload, or share User Content that:

  • Is illegal, harmful, threatening, abusive, or discriminatory
  • Infringes on intellectual property rights
  • Contains personal information of others without consent
  • Contains viruses, malware, or malicious code
  • Violates any applicable laws or regulations

6.5 Content Removal

We reserve the right to remove any User Content that violates these Terms, although we have no obligation to monitor User Content.

7. Artificial Intelligence Features

7.1 AI-Powered Study Plans

The App uses Apple Intelligence and machine learning technologies to generate personalized study plans. You acknowledge that:

  • AI-generated content is provided for informational purposes only
  • AI-generated study plans should be reviewed and adapted to your specific needs
  • We do not guarantee the accuracy, completeness, or effectiveness of AI-generated content
  • AI processing occurs on-device using Apple's technologies

7.2 OpenAI API Key and Custom API Integration

The App allows you to optionally provide your own OpenAI API key for advanced AI features. You acknowledge and agree that:

  • Your OpenAI API key is stored locally on your device in the system Keychain
  • Your API key is never transmitted to our servers or any third party except OpenAI
  • You are responsible for maintaining the security and confidentiality of your API key
  • You may delete your API key from the App at any time through the settings
  • Your use of OpenAI's API is governed by OpenAI's Terms of Service and Policies
  • You are responsible for all costs associated with your OpenAI API usage
  • We do not charge for API calls; those charges come directly from OpenAI based on your usage
  • We do not store, log, or access the content of your API requests or responses

7.3 AI Limitations

You understand and agree that:

  • AI-generated content may contain errors or inaccuracies
  • AI features require compatible devices and software versions
  • AI functionality depends on Apple's frameworks and may change
  • OpenAI's API features, pricing, and availability may change at any time
  • We are not responsible for decisions made based on AI-generated content
  • We are not responsible for OpenAI API costs, rate limits, or service interruptions

8. Data Usage and Privacy

8.1 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Data Processing

The App processes data as follows:

  • Local Processing: Study plan generation occurs on-device using Apple Intelligence
  • Subscription Data: Payment and subscription information is processed by Apple and RevenueCat
  • Optional iCloud Sync: If enabled, your data is synced via Apple's CloudKit
  • Analytics: We may collect anonymized usage data to improve the App

8.3 Third-Party Services

The App uses third-party services:

  • Apple Intelligence: On-device AI processing (governed by Apple's terms)
  • OpenAI API: Optional API integration for advanced AI features (governed by OpenAI's terms)
  • RevenueCat: Subscription management (governed by RevenueCat's terms)
  • iCloud/CloudKit: Optional data sync (governed by Apple's terms)

9. Intellectual Property Rights

9.1 Our Intellectual Property

The App and its original content, features, and functionality are owned by Nestor Studio and are protected by:

  • International copyright laws
  • Trademark laws
  • Patent laws
  • Trade secret laws
  • Other intellectual property rights

9.2 Trademarks

“Study Mood”, “Study Mood Pro”, and associated logos are trademarks of Nestor Studio. You may not use these trademarks without our prior written consent.

9.3 Feedback

If you provide us with feedback, suggestions, or ideas about the App (“Feedback”), you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the App without compensation or attribution.

10. Third-Party Services and Links

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for:

  • The content of third-party websites
  • Privacy policies of third-party services
  • Practices of third-party services

You acknowledge and agree that we are not liable for any damages arising from your use of third-party websites or services.

11. Disclaimers and Limitation of Liability

11.1 Educational Purpose

THE APP IS PROVIDED FOR EDUCATIONAL AND ORGANIZATIONAL PURPOSES ONLY. THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL EDUCATIONAL ADVICE, TUTORING, OR ACADEMIC COUNSELING. ALWAYS CONSULT WITH QUALIFIED EDUCATORS OR ACADEMIC ADVISORS FOR SPECIFIC EDUCATIONAL GUIDANCE.

11.2 “AS IS” Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NESTOR STUDIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL
  • ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP
  • ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR DATA
  • ANY DAMAGES ARISING FROM ERRORS, MISTAKES, OR INACCURACIES IN CONTENT
  • ANY DAMAGES ARISING FROM AI-GENERATED CONTENT OR RECOMMENDATIONS

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

11.4 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

  3. YOU HAVE THE LEGAL CAPACITY TO ENTER INTO THESE TERMS
  4. YOU ACCEPT ALL RISKS ASSOCIATED WITH USING THE APP
  5. YOU UNDERSTAND THAT THE APP USES AI TECHNOLOGY AND ACCEPT THE LIMITATIONS THEREOF
  6. YOU AGREE TO THE SUBSCRIPTION TERMS AND PRICING
  7. YOU HAVE READ AND UNDERSTOOD OUR PRIVACY POLICY

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
